GENERAL CONDITIONS OF SALE
The current General Conditions of Sale (G.C.S.) govern the sale of the goods (Products) marketed by Sovil srl, with registered office in Rome and seat of operations in Soriano nel Cimino (VT) - 01038 - Strada Statale N° 204 Ortana - Loc. Sanguetta – Italy – VAT no. IT00109020560 (Sovil).
All the contracts (Orders) for the sale of Products by Sovil to its Clients are governed by these G.C.S., which have been specifically approved by the Customer in accordance with Arts. 1341 and 1342 of the Italian Civil Code, and which constitute an integral and substantial part of all Purchase Orders. The G.C.S. applied to all Orders are those in force at the date of the Order itself.
The G.C.S. do not affect any rights that may derive from binding provisions of the Italian law in relation to Customers acting as consumers, this meaning any physical person who acts for purposes unrelated to any entrepreneurial or professional activities they may otherwise engage in.
All Orders made through the site are taken as being made by private customers for their own personal use.

1. Orders
1.1 The sale of the Products takes place from a distance. The Order will automatically be recorded and purchased complete of these G.C.S., having specifically approved ex. Art. 1341 and 1342 of the Italian Civil Code. After acquisition, the Order may only be modified by telephone, fax or email, at the numbers and electronic mail address indicated in the site (contacts) respectively.
1.2 Each Order constitutes contractual acceptance by the Customer and sale is considered concluded at the time of registration of the Order. Sovil reserves the right not to fill Orders either because they are incomplete, or because of non-observance of the provisions as per Art. 3.1 and 3.3.
1.3 In the event in which the order is not filled because of lack of availability of products or for any other reason, Sovil will inform the Customer thereof, each time establishing with the latter the terms of delivery of the products and/or refund of any amounts received. In either case, the Customer will not be entitled to any additional refunds or other indemnity or compensation of any kind.
2. Prices
2.1 All the prices indicated on the site are expressed in Euros and already include the VAT in force as of the 17th of September 2011.
2.2 The prices of the individual products displayed in the site are valid up to the 28th of February 2012. The offers are valid for the same length of time unless otherwise indicated. In any case, the company reserves the right to be able to initiate any type of promotion at any time.
3. Payment and delivery of the Products
3.1 Payment of the total amount of the Order can be made by means of a single payment using credit card or bank transfer. For deliveries within Italy, the contribution towards shipping amounts to € 8.00. For deliveries in other Countries, the contribution towards shipping will be calculated each time by the Internet site, indicating the best offer available and allowing the possibility (if feasible) of choosing between air or land carriage. In the event in which it is not possible to view the charges for the contribution towards shipping, the Customer will be contacted by Sovil via email.
3.2 Delivery will be made by post or express courier (“Carrier”) and is to be understood as being up to the point closest to the address indicated by the Customer in the Order that can be reached by the Carrier. Dispatch does not include delivery to the floor.
3.3 Delivery times fall between 2 and 8 working days from the time of receipt of financial confirmation of the Order. These times are merely indicative and are not binding. Sovil is not in any way responsible for direct or indirect losses related to the delay in delivery.
4. Characteristics of the Products
4.1 The Products present on the site are distinguished by the brands Sovil and Livos, which belong to Sovil. Sovil reserves the right to change the characteristics of the primary and secondary packaging of the Products with respect to those displayed on the site without prior warning and for purposes of improvement.
4.2 The Customer is responsible for the choice of the products ordered and for the compliance and conformity to his needs of the specifications indicated. No guarantees are given regarding the compatibility of the products with other products or equipment used by the Customer, nor is any guarantee given regarding the suitability of the products for the specific use intended by the Customer.
4.3 We will be responsible for any lacks or damage visible at the time of delivery and that were obviously caused by handling without any charge to the Customer, provided that specific mention is made on the documents accompanying the products.
4.4 Complaints made against any defective or missing parts must be sent to the Centre of Operations within five (5) days from receipt of the products.
4.5 Sovil is not responsible for the improper use of its Products by its Customers or by anybody else.
5. Place of jurisdiction.
5.1 All disputes will be settled by the Court of ROME (Italy).
Right of withdrawal
Pursuant to Italian law and in accordance with Art. 5, Legislative Decree 22.5.1999 no. 185, the consumer may cancel his Order within 10 working days from the date of receipt of the Products. The right to withdraw is enforced by means of written notice, to be sent to Sovil srl, Strada Statale N° 204 Ortana (Loc. Sanguetta) - 01038 Soriano nel Cimino (VT) – Italy - by registered letter with return receipt or by means of telegram or fax later confirmed by registered mail with notice of receipt within the subsequent 48 hours.
The notice of withdrawal must indicate the number of the Order from which you are withdrawing, the product to be replaced, the method chosen to refund any amounts paid. At his own expense and charge, the consumer must return the Products, perfectly intact and in their original packaging, within maximum 10 working days from their receipt, to Sovil srl c/o Strada Statale N° 204 Ortana (Loc. Sanguetta) - 01038 Soriano nel Cimino (VT) - Italy. Sovil will refund the amounts paid by the Client within the times established by law.
Supplementary notes
The colour of the products presented in the Catalogues and in our web sites may suffer from the conditions of light in which the photos were taken, as well as from the printing quality or the settings of the screen of the systems on which they are displayed.
All drawings and measurements are purely indicative; we reserve the right to change the technical characteristics of the elements shown without any prior notice, also in view of the constant technological evolution underway.
We do not take any responsibility for the use and assembly that is made of the materials sold, referring specifically to the urban, static and safety standards in force at the place of installation. We do not take any responsibility for any direct and/or indirect damage caused by incorrect assembly or by the poor quality of the installation works made on site.
